This Site is owned by the Trustees of the British Music Hall Society (BMHS, we, us or our). By using or accessing the Site, you agree to be bound by the following terms and conditions. If you do not agree with or accept any of these terms and conditions, you should stop using the Site immediately.

When we use the word “Content” in these Terms, we mean any text, images, video, audio or other multimedia content, software, or other information or material submitted to or on the Site.

The BMHS may make changes to the material on this Site at any time without notice. The material on this website may be out of date, and the BMHS makes no commitment to update such material. Furthermore, we cannot promise that the Site and the Content on it will be fit or suitable for any purpose. Any reliance that you may place on the information on this Site is at your own risk.

While we try to make sure that the Site is normally available 24 hours a day, the BMHS shall not be liable if for any reason this Site is unavailable at any time or for any period.

We may update and change our Site, and the Content on it, from time to time to reflect changes to our services, our member’s needs, and our organisation’s priorities.
6. Access and Use of the Site
6.1

You must not attempt to gain unauthorized access to the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

This Site, Content, and all intellectual property rights in it are owned by us, our licensors, or both (as applicable). 7.3.3

9. Limitation of Our Liability

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation;

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products or services to you, which are set out in separate terms and conditions;

Unless prohibited by law, our maximum aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall in all circumstances be limited to £50.00;

To the extent permissible by law, we exclude all implied conditions, warranties, representations, or other terms that may apply to our Site or any Content on it;

You shall indemnify us in the event that we incur any claims, costs, damages, losses, or other liability through using the Site or Content in breach of these Terms; and

You acknowledge that the Site has not been developed to meet your individual requirements.

If we decide not to exercise or enforce any right that we have against you at a particular time, then this does not prevent us from later deciding to exercise or enforce that right.

Each of the conditions of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
10.5
These terms and conditions are governed by and construed in accordance with the laws of England and Wales and any disputes are to be decided only by the courts of England and Wales.
